The Company reserves the discretion to withdraw any Material from the e-portal without prior notice and to refuse any Material / Information posted / uploaded by a User.
The Company reserves the right to suspend / block or terminate a User's account where, in its absolute discretion, it deems such suspension appropriate. In the event of such suspension or termination, the Company will notify the User by email (if provided by User) and the User must not seek to re-register either directly or indirectly through a related entity.
The Company owns all Intellectual Property Rights in the e-portal and the Service either register or un-registered, including without limitation, the design, text, graphics, the selection and arrangement thereof.The following restrictions shall apply to all Users:
The Company permits the User to post Material on the e-portal in accordance with the Company's procedures provided that Material is not illegal, obscene, abusive, threatening, defamatory or otherwise objectionable to the Company.
The Company will make all reasonable efforts and technical measures so that the Services and access to the e-portal can take place smoothly and without interruption and that an adequate level of security is maintained. However, the Company does not guarantee that the Services and the e-portal will be available without interruption and without errors.
The Company is not liable, though, if for any reason, negligence included, despite the maintained security measures adopted by the Company, the operation of the e-portal is interrupted or access to the e-portal or the User Profiles becomes difficult and / or impossible or if viruses or other harmful software is identified and transmitted to the terminals of the users / visitors, or if third unauthorized parties intervene in any way to the Content and operation of the e-portal making the use of it difficult or causing problems to its proper function. Moreover, we are not liable if the e-portal is not accessible for reasons beyond our control as well as for reasons due to technical or other failure of the backbone network or for reasons of force majeure or incidental facts.
The Company is not liable for any failure in respect of its obligations hereunder which result directly or indirectly from failure or interruption in software or services provided by third parties. The Company is not responsible for the direct or indirect consequences of a User linking to any other website from the e-portal.
No matter how many claims are made and whatever the basis of such claims, The Company's maximum aggregate liability to a User under or in connection with this T&C in respect of any direct loss (or any other loss to the extent that such loss is not excluded by above Clauses or otherwise) whether such claim arises in contract or in tort shall not exceed a sum equal to the value of any amount paid to the Company by the User in relation to which such claim arises.
The User hereby agrees to indemnify the Company against all liabilities, claims and expenses that may arise from any breach of this Agreement by the User. All warranties, express or implied, statutory or otherwise are hereby excluded.
We may use third-party advertising companies to serve ads when you use our e-portal. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites to provide advertisements about goods and services of interest to you.
We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners, and from us in general, after setting up an account.
